Referral for Workmens Comp attorney that has tried cases.


General w.c. practice is to take a case, get an offer from the insurance company and take the percentage of settlement. 


Looking for names of attorneys that have actually argued cases.


I Googled and the only lawyer listed under Workers Comp that I know personally is Craig Livingston in Nutley. I suggest that you call around and ask pointedly how many cases they have actually tried.

There is also a possible suit for medical malpractice with employer's comp. M.D.


Injury was sustained. X-rays were taken. Employee was directed to report to work by physician who hadn't read the X-rays. The subsequent work resulted in further damage that ended up with surgery.


Then, the physician read the X-rays.


Would this require a separate attorney for the med malpractice claim?


Jack, the attorney may be entitled to a lien on your case for the fair market value of the work done for your case. In any event it shouldn't mean more out of your pocket because these things are usually done on a contingency arrangement.   The two lawyers would work that out between themselves.    It wouldn't necessarily need a separate attorney if the attorney had experience in both areas, as many do.   I will PM you a few recommendations for consults or calls.
