Have the Sioux had their day in court? If the lands through which the pipeline passes are indeed sacred ground, they should get a fair hearing in a court, regardless of whether or not those lands are part of one of the reservations.
So far, the one thing that is really clear is that the government use of force in this situation is really excessive. The government did nothing like this when responding to the right wingnuts occupying the buildings at the Malheur Wildlife Reservation.

I believe they are waiting to hear whether the land can be seized under Eminent Domain
